Department of Justice Adopts 2010 ADA Standards for Accessible Design

The adoption of the 2010 ADA Standards for Accessible Design (2010 ADA Standards) adds yet another layer of complexity to the multitude of already complicated and confusing interrelated accessibility laws, standards, and guidelines pertaining to property and program access. While the 2010 ADA Standards are intended to outright replace the 1991 ADA Standards for new construction and alterations, they impact existing facilities and are broader in scope than their predecessor. The requirement for retroactive barrier removal remains related to elements not previously covered in the 1991 ADA Standards and to elements not in compliance with either standard. While it is beyond its scope to fully clarify either the extensive changes to the ADA Standards or the relationship of the ADA with other civil rights laws and building codes, the document at the link discusses several basic facts that are crucial to understanding the new standards.
