A number of states and cities have adopted requirements for commercial building owners to provide benchmarking information on their buildings. These requirements generally make use of the Portfolio Manager benchmarking tool developed by the Environmental Protection Agency. For some jurisdictions, this information is to be provided to the jurisdiction that will make the information available to the public. For other jurisdictions, the information is required to be disclosed to a buyer, lender, or prospective tenant. The history, requirements, and effective dates for the various jurisdictions are summarized below. The list of jurisdictions with requirements is based on information from the EPA Energy Star website that was last updated June 2011 and from the websites of various jurisdictions. The information below applies to privately-owned buildings, as the rules are different for public buildings.
