The California Energy Commission has issued revised draft regulations for implementing the disclosure requirements of Assembly Bill 1103. Implementation will now begin January 1, 2013, for buildings larger than 50,000 square feet, July 1, 2013, for buildings larger than 10,000 square feet, and January 1, 2014, for buildings larger than 5,000 square feet. This applies to nonresidential building Occupancy Types A, B, E, I-1, I-2, M, R1, and S and Type U parking garages.
Prior to execution of a sales contract or lease for an entire building or submittal of a loan application, the owner shall provide the Disclosure Summary Sheet, Statement of Energy Performance, Data Checklist, and Facility Summary. The first document will come from a special Energy Commission website, while the other documents come from the EPA Portfolio Manager tool. The owner must set up a Portfolio Manager account for the building and can request that the utility companies provide data for the building. The utility companies must upload at least 12 months of data upon receipt of the request. Gone is the prior attempt to establish a separate California database for comparison purposes.
